Student protester hit by car as she blocked freeway sues UC San Diego

The University of California-San Diego is now embroiled in a personal injury lawsuit after an election protest gone wrong.

Mariana Flores, a sophomore at UCSD, was demonstrating against Donald Trump’s victory on a busy San Diego freeway when a vehicle hit her. The accident crushed her pelvis, fractured her leg, and caused other serious injuries, reported The Guardian campus newspaper.

Flores, in her suit filed in late November, partly blames campus officials for her injury, arguing they should have stopped the protest before it got dangerous, according to news reports.

Flores’ attorney did not respond to requests from The College Fix seeking comment. A UC San Diego spokesperson said that the university could not comment on pending litigation.

The Nov. 2016 protest had began at “Library Walk” and journeyed through campus. Next, demonstrators ended up on the I-5, a very large and busy eight-laned freeway that cuts through San Diego.

The car that stuck Flores had gotten around an emergency vehicle that had been attempting to block traffic so authorities could shut down the freeway, according to the Los Angeles Times.

In an interview with The Guardian, Gene Sullivan, Flores’s lawyer, asserted that the university planned, organized and knew the protest was happening for hours and did nothing to stop it.

“According to Sullivan, not doing anything and failing to act is legally the same thing as supporting the protest,” the newspaper reported. “Sullivan further alleged that the protest was encouraged by people in positions of authority at the university, and that ‘if anyone that is in authority with the university – a [Residential Advisor] – says ‘let’s go,’ the university would be responsible.’”

The complaint also lists the University of California Regents, the city and county of San Diego, the state of California, and the driver of the vehicle as defendants in the lawsuit.

When asked about the lawsuit by the Los Angeles Times, Sullivan said “We think it’s a case of shared responsibility of the school, Maria and the driver, and we’re not saying that anybody is without fault or fault-free. We think other people bear some responsibility as well.”

In addition, Sullivan explained that if any person representing the university, even if that person is simply a Residential Advisor, encouraged students to go to the protest, then the university would bear responsibility.

While Sullivan admits that Flores is partially responsible for her injuries, he claims that, under the doctrine of comparative responsibility, the jury will get to decide what percentage of the injury is the fault of the plaintiff and what percentage of the injury is the fault of the defendant. Damages will be levied based on percentage.

The lawsuit seeks attorneys’ fees, court costs, and unspecified damages, the Times reports.

      I live near, and often work around a major state university. My experience with a large number of university students is that they are incapable of crossing the street without adult supervision.
      I have witnessed an incredible amount of these children auditioning for a career as hood ornaments.

      I often drive that very same freeway and it was late at night. A lot of drivers feel more comfortable driving much faster and not being the most attentive when the roads are way less busy and aren’t normally expecting people blocking the freeway. They arguably picked the worst and most dangerous time to spontaneously block the freeway.

    If they were no longer on campus property, then how does she even remotely figure that the university is responsible? Like others have said, if they tried to stop the protestors, that would have gotten a different lawsuit.
    I’m sorry- but you block a highway, you get what you deserve. The law enforcement officers should have been forcibly removing them (or just let them walk and let traffic do what traffic does). “Survival of the fittest”

    They don’t understand that the Constitution does NOT give you the right to block or infringe on the rights of others. It says you can PEACEFULLY assemble, and yes you can speak. It does not say you can forcefully stop me from moving around- be it a sidewalk, or a highway.

    I can only imagine what our country will look like 20 years from now when the kids in college and high school NOW are the ones in running it. Heaven help us (literally)

    So, using this logic …. the person leading the protesters into the road should be held responsible, the organization sponsoring the protest would be responsible, and if the police were notified of the protest, they would be responsible for not insuring safe conduct of the protesters while violating the laws of the state/county as well as common sense. I now guess that the US is responsible for the safety of hikers on federal lands who fall or run into bears, snakes or other climatic difficulties – if you pay for admission, the country is responsible if there just happens to be a blizzard or wildfire regardless of existing hazards or projections. It is indeed logical that there would be moving traffic on a multi-lane highway – the girl assumed the risk – and the consequences for her actions! Telling a college employee of your idiotic plan does not transfer the responsibility to the institution for your stupidity – she should be expelled.

I’m convinced that Hillary’s epic, though completely predictable, loss triggered the vast majority of the useful-idiot levels (99%) of the Left into what could well be the largest and most intense case of mass hysteria on record.

    Street leftists/progressives/liberals and even most of the upper ruling echelons are true-believers. That is when one considers the Left as a religion where the deity is big, all-powerful government from which all good things flow (or would if Trump weren’t POTUS…) then their behavior makes a lot more sense.

    The truth is that the Left has a lot in common with Islam in terms of their irrational beliefs and hatred of those who choose not to submit to their ideological dogma. Both are authoritarian movements. Both are highly prone to violence to achieve their ends. Both are profoundly un-American.

    My kids learned not to play in traffic when they were 5. College students claim that their sex lives should not be under the supervision of their schools; I should hope that it would be obvious that they should not have to supervise them to ensure they don’t run out on a freeway.

    Neither a University nor it’s agents have any business encouraging anyone to participate in or not participate in a protest. As the University of Chicago explained in it’s free speech position:

    “In a word, the University’s fundamental commitment is to the principle that debate or deliberation may not be suppressed because the ideas put forth are thought by some or even by most members of the University community to be offensive, unwise, immoral, or wrong-headed. It is for the individual members of the University community, not for the University as an institution, to make those judgments for themselves, and to act on those judgments not by seeking to suppress speech, but by openly and vigorously contesting the ideas that they oppose.”

    One of the first things a child learns is to look both ways before crossing the street. To even intimate that anyone other than the protesters sponsible for her injuries is irresponsible. And if the university HAD tried to stop the protest, the scream would have been loud and clear about their free speech rights being stomped on. You can’t have it both ways people!

    How about a little personal responsibility? Even very young children know not to play in traffic. If you stand in the middle of the road with the sole intent of blocking traffic.. and not to enhance the safety or enable the rescue of another person…

    Further, the driver nor the university should bear responsibility. She was trying to unlawfully detain people.
