Despite Protest, Public High School Allows Boy To Use Girls Locker Room

LOS ANGELES – One of the largest public charter high schools in the nation allows a boy who identifies as female to use the girls locker room and bathrooms – despite protests from a female student who says she feels uncomfortable and vulnerable by his presence.

What’s more, the female student – who just finished her sophomore year at the Los Angeles-based Granada Hills Charter High School – claims the boy in question harassed her, touched her hair, stared strangely at her, and also peeked at girls over the stalls while they used the toilet.

“It’s amazing to me that a public school who is responsible to protect the rights of all students will blatantly ignore the Constitutional right to privacy of young female students within the locker rooms and restrooms of the school,” Robert Tyler, the girl’s attorney, told The College Fix.

Tyler, who heads up the Southern California-based conservative public interest law firm Advocates for Faith & Freedom, sent a letter to the school late last month asking them to provide alternate locker room facilities for the male student who identifies as female. But attorneys for the school, in a June 4 letter to Tyler, denied the request.

“The charter school provides a safe environment, free from discrimination and harassment for all of its students,” stated the letter to Tyler from the school’s attorneys, the law offices of Young, Minney & Corr., LLP. “From our initial review of this matter, we are confident that the evidence will demonstrate that any issues and incidents between the students were mutual, and your client was not victimized in the manner described in your letter.”

The 10-year-old public high school enrolls about 4,200 students and describes itself online as the largest public charter high school in the nation. To protect the privacy of the minors involved, the names of the high school students cited in Tyler’s letter were redacted in a copy he provided The Fix.

That letter, sent May 28 to leaders of the award winning and academically successful Los Angeles Unified School District campus, detailed the sophomore girl’s claims. It noted she was surprised when she transferred there in January and was assigned a locker next to a male student in a secluded corridor of the changing room.

“(The female student) was immediately uncomfortable being required to change into her PE clothes in front of (the male student),” the letter stated. “This caused her to feel unnecessarily vulnerable to this male student. Meanwhile, (he) never changed into his PE clothes and, instead, awkwardly stared at (her) while she changed. In fact, he touched her hair and would often comment upon her appearance. (He) was allowed to walk around the locker room and gawk at other females, likewise commenting upon their hair and other features.”

The female student eventually started sharing a locker with a female friend in another aisle, after which the male student and his friends began to pick on her, harass her, and start fights with her, the letter stated, adding it went on all semester.

Tyler also stated in his letter that the male student was known to hang out in female bathrooms, and the lawyer interviewed at least three female students at the school who confirmed they saw him peek at girls over the stalls while they used the toilet.

“Numerous females on your campus have expressed serious concerns over their privacy and safety as a result of (his) conduct, and are left vulnerable to unlawful harassment,” Tyler stated. “The personal dignity and privacy of all females within the Granada Hills Charter High School is infringed as a result of one student’s desire to identify as a female when he is biologically a male.”

“It is astonishing that the Constitutional rights of hundreds of female students are ignored for the sake of the statutory right of one student to claim the identity of the opposite sex. This injustice cannot be tolerated.”

However, it remains to be seen what will come of this matter, Tyler said. For now, school’s out for summer, he said. No lawsuits have been filed.

But the situation is a precursor of things to come for California, Tyler said in an interview with The Fix.

He cited Senate Bill 777, signed into law by Gov. Arnold Schwarzenegger in 2007, which essentially changed the definition of gender, saying: “ ‘Gender’ means sex, and includes a person’s gender identity and gender-related appearance and behavior, whether or not stereotypically associated with the person’s assigned sex at birth.”

The law helped create the situation now facing Granada Hills Charter High School, because it allows boys who identify as girls to legally use the girls’ restrooms and locker rooms, he said.

“The mischievousness of the transgender nondiscrimination laws will be in effect come fall,” he said. “We will be back on it again. This is really just the start of the many problems California schools are going to face in the coming school years as a result of this new definition of gender.”

In California there is no restraint to the perverts that control the union teacher/child molester alliance….they are one and the same…..

    • Michael Ejercito

If only we can purge the perverts and buggerists from our educational system.

California continues to lead our country downward.

What about the majority of girls that are made uncomfortable by a boy in their locker room? The desire of the one now trumps the desire of the majority??? The charge of discrimination or racism is the best tool to take away the rights of the majority almost without discussion! ENOUGH ALREADY!!

    • Terri Tg

majority??? it was 3, and that was just their claim, since the whole story was a fabrication, it was probably 0. maybe she was a little forward with her appreciation, they have what she wants to have, etc. it is probably more flattery taken wrong than perversion

Good for the school. The article desperate tried to skew things to fit their agenda, but note a couple of facts. First, the award winning and academically successful” school investigated the issue and found that the student “was not victimized in the manner described in your letter” (kids lie). And second, it noted that she was a transfer student. It seems to me that this is a new kid who probably came from an area where she wasn’t exposed to transgender students (or much of the LGBT community for that matter) and is making ridiculous claims to change a policy that she personally disagrees with…

    • HughMan

Well said. Not sure why people are so stupid about this.

      • 1Path2God

because were God’s creation and we have no right to question our nature and change/modify our bodys because it makes us happier or healthier. we are made in his image, and if we were supposed to be different, then Adam and Eve would have been different.

        • Sanity

um…are you saying that bodily modification to make yourself healthier (i.e. surgery, transplants, prosthetics) is equivalent to bodily modification for other reasons (tattoos, breast implants, sex change, etc), and both are wrong?

that is possibly the worst anti-trans argument I have ever heard. wtf religious fundamentalism?

        • Terri Tg

you obviously havent read the bible much, many times it mentions that souls are neither male or female, so if he is only interested in our immortal souls, how is making our bodies fit our souls wrong? in your statement, i hope you havent had any medical care as any inoculation would be considered modification. as to questioning our nature, that is the issue here, “our” nature is what we are trying to express and become properly. whether it is a “birth” defect, or some external reason, things go wrong in gestation. we are just trying to correct that.

    • MostlyReasonable

Wow, when I was in high school this was just not an issue. There was a trans girl, and she (or whatever pronoun you wanna use) used the girls bathroom, though she had asked if that would make people uncomfortable, and was willing to use a different one. nobody cared, not even the trans girl. was I just lucky enough to go to school with reasonable people?

      • Terri Tg

unfortunately you were. I wish it was more prevalent, when was this btw? and it has been happening quietly for the most part in a lot of areas, but with this bill and others like it guaranteeing those policies it has set the hate mongers on the war path. and in all that time, no complaints from kids or parents made public at least.

  • NaniSusan

it seems the “feminine” feelings of one boy trumps the necessity of privacy for the girls at this high school. California – you have lost your “golden”.

  • Rachie

I graduated from GHCHS last year. It’s a great school, and I loved it!However, I think this tricky situation could have been handled a LITTLE better. The transgender student should use the restroom/change in the nurses’ office or in the single occupant “resource” restroom located right next to the locker rooms. Both restrooms are conveniently located, if the student needed another I suppose an exception should be made to allow the use of the faculty women’s room (so that female students wouldn’t be made uncomfortable). That would be three bathrooms right next to the only three bathrooms available to ANY student (except more private and perhaps cleaner) Don’t force the kid to change with boys, and don’t force girls to change with the kid.

    • Terri Tg

ok so you would be ok being segregated? yeah the SCOTUS said that was illegal a LONG time ago. do a little more research, most transkids, if they arent beaten by their parents, siblings and bullies (some hospitalized or KILLED) are shy about their bodies, which dont fit their mind/soul. they dont WANT to show off, etc. it might have been more a factor of ANY other girl saying “oh what a cute outfit” or “your hair is so great looking” etc. did she say “please dont touch my hair” didnt say so if she did.

  • YTK

KUDOS to that brave transgender student!! The school needs to accomodate her but if she has not totally transitioned she might be making the girls uncompforable, so she COULD be given her own changing room and STILL be able to identify as female by participating in the girls activities.

    • Retnan

Sounds like “she” is a dyke eh?

      • Terri Tg

one a “dyke” is a masculine lesbian, she is NOT that. she might be a lesbian but does that have anything to do with this story? no, just your sick imagination i am thinking.

        • Retnan

In common slang “dyke” is used to refer to ANY lesbian, I don’t care if that doesn’t match your lesbian sub-type dictionary.

“but does that have anything to do with this story?”

Um YEAH!!! Did you read the story!!

  • YTK

KUDOS to that brave transgender student!! The school needs to accomodate her but if she has not totally transitioned she might be making the girls uncomfortable — so she COULD be given her own changing room and STILL be able to identify as female by participating in the girls activities.

Liberalism is a mental disorder…What will these left wing dingbats do when one of these “transgendered boys” rapes one of the girls they share the locker room with?

    • Terri Tg

please show me ONE case where a true diagnosed and in treatment transgender raped ANYONE much less a child doing it. you cant because it has never happened. now Transgender persons have been raped, beaten and KILLED by people who think like you do, but NOT the other way around

Reminds me of a corny joke I once heard:

Husband: I have good news and bad news.

    Wife: What’s the bad news?

    Husband: I’m a woman trapped in a man’s body.

Wife: Oh, no! What’s the good news?

    Husband: I’m a lesbian.

  • Terri Tg

and this story has like every other one like it spewed out by these hate groups has been proven to be fabricated, a lie.

  • Jamie Delarosa

Oh good grief – another faked, planted story to stir up support for the proposed ballot measure.

“Cristan: I’m calling to verify some information that I saw on the channel 10 news.
LAUSD: I’m sorry, what information are you trying to verify?
Cristan: Sure, sure, on channel 10 news it says that, at least on their website,
that a LA high school student complained because a transgender kid was
in the restroom peeking over stalls. And so that’s on the news and I just wanted to fact check that claim. Have you actually received complaints of transgender children climbing over stalls to look at other people as they’re in the stalls?
LAUSD: I will have to check that for you. I believe that was fabricated, but give me one second. I need to verify. Hold on for a second.
    Cristan: Okay.
LAUSD: Because it’s been a few days since we got that report. So hold on for me.
    Cristan: Sure.
    [On Hold]
LAUSD: I apologize for the wait. They did get the complaint and it turned out
that it was fabricated by one of the parents who opposes transgender
students in schools. So it was an unfortunate situation, to have to put
the students through, but it was fabricated.”
